27-year-old Buckie drink driver denies refusing urine test without excuse

A BUCKIE man has admitted drink driving and withholding information from police, but denied failing to provide a urine sample without good reason.

Ryan Mair (27), of West Church Street, was stopped on the A96 between Fochabers and Keith at half past Midnight on June 2.

However, he refused to identify himself as the driver and was later found to be three-and-a-half-times over the alcohol limit.

Elgin Sheriff Court heard Mair had a blood-alcohol level of 174, in excess of the limit of 50.

The 27-year-old, however, pleaded not guilty to refusing to provide a urine sample for testing at Dr Gray's Hospital in Elgin "without reasonable excuse".

Sheriff David Harvie, presiding, said Mair had prior convictions including one which solicitor Robert Cruickshank described as a "a very relevant one".

Describing the charges admitted by the Buckie man as "quite serious", Sheriff Harvie deferred the case for reports and disqualified the 27-year-old from driving in the interim.

“We need to look at what options we have to make sure you do not continue in this line," Sheriff Harvie said.

“It is in your interest to cooperate with the preparation of the report.

"No driving as of now."

Mair's case will call again on Thursday, February 1.
